Legal Basis

Article 2 (3) of Regulation no. 1907/2006/EC (REACH) stipulates that Member States may allow for exemptions from this Regulation, in specific cases for certain substances, on their own, in a mixture or in an article, where necessary in the interests of defence.

The HSA (Health and Safety Authority) is the Competent Authority of Ireland for REACH and may grant an exemption according to article 2(3) of the REACH Regulation.

Description of National Procedure

Currently, there are no procedures or polices in place in Ireland to allow for exemptions under REACH in the interest of defence.

Description of National Safeguard Measures

The Safety, Health and Welfare at Work (Chemical Agents) Regulations 2001 (S.I. No. 619 of 2001) and the Safety, Health and Welfare at Work (Chemical Agents) (Amendment) Regulations 2015 (S.I. No. 623 of 2015), set out the framework for the prevention of risks to safety and health related to exposure to hazardous chemical substances at work. The Irish Defence Forces complies with the following national and international legislation.

  • The Safety, Health and Welfare at Work Act 2005.
  • The Safety, Health and Welfare at Work (Carcinogens) Regulations 2001, incl (Carcinogens) Amendment 2015.
  • 2016 Code of Practice for the Chemical Agents Regulations” in accordance with section 60 of the Safety, Health and Welfare at Work Act 2005 (No. 10 of 2005).
  • Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation (No. 1907/2006).
  • Classification, Labelling and Packaging of Substances and Mixtures (CLP) Regulation (No. 1272/2008).
  • Rotterdam Regulation (No. 689/2008) concerning the export and import of dangerous chemicals under the Rotterdam Convention.
  • Detergents Regulation (No. 648/2004).
